Throughout the duration of this course students have been introduced to several amendments in the U.S. Constitution and the Bill of Rights. Please review the summary of the amendments in the Bill of Rights presented in the course lecture and answer the following questions:

Which amendment from the Bill of Rights do you believe is the most important and has had the largest impact on society today? Why? How does this amendment impact your daily life from a professional and personal standpoint?

Please include the name of the person or question to which you are replying in the subject line. For example, “Tom’s response to Susan’s comment.”

Classmate 1 Allena

The amendment from the Bill of Rights that I believe is the most important and has had the largest impact on society today is the Fourth Amendment. The Fourth Amendment protects citizens from unreasonable searches and seizures and it requires warrants to be issued based on probable cause given to a judge or magistrate under oath (U.S. National Archives, n.d.). The warrants must also describe in detail where they want to search and what or who they are looking for (U.S. National Archives, n.d.). This is a hot topic issue in society today because some people question the validity of certain law enforcement/government actions on this topic, such as DUI check points. Many videos have gone viral from traffic stops or other police encounters where people have filmed their interactions with law enforcement and questioned their actions.

This amendment impacts my daily life from a professional standpoint because these rights shape my job as a law enforcement officer. I cannot take someone into custody without a warrant or without probable cause and giving my statement under oath to a Magistrate. I cannot search a vehicle just because I have a hunch or because I want to. I have to have probable cause or a search warrant, outside of a few warrantless exemptions. When I want to search a home for evidence of a crime, I have to swear out an affidavit to a Magistrate describing where I want to search, what I want to search for, and my probable cause for doing so. These actions are the core of my every day job. This amendment impacts my daily life from a personal standpoint because my family and I are protected by these same important rights.

Classmate 2 Yolonda

The most important Amendment for me would be the First Amendment, it gives freedom of religion, speech, press, and petition which limits government and guarantees freedom. Without these fundamental rights, America would not be the “land of the free”. This amendment allows us to make our own decisions on how we teach our children, practice, worship how we want and observe religion. This is a freedom that not all countries have. The freedom of being able to speak and write about things that we wish, imagine if everything we read and did on the Internet was censored by the government. The freedom to protest, without this amendment, the civil rights movement may not have happened. This amendment also gives us the right to petition the government if we feel the government is abusing their power, the amendment makes them answer to a petition filed against them giving the people a right to an explanation. We would not have the country we have today without the First Amendment. This amendment impacts my daily life from a professional and personal standpoint because it gives me the freedom to be who I am today.

Part 2

Submit: Unit VIII Research Project Requirements

In this assignment, students will be required to reflect on historical Fourth Amendment cases. The Fourth Amendment protects U.S. citizens from unreasonable searches and seizures. However, what if the location of the search is in an unusual location? What about an obvious conventional location? For this assignment, students will focus their essays on four specific areas to include searches conducted: in homes, on an individual person, in public schools, and in motor vehicles.

Choose one case from each of the four areas to discuss how the Fourth Amendment has changed over time based on the physical area investigated by law enforcement offices. Should the specific area matter? Should there be different parameters based on the area searched? Why, or why not? Your essay should include a minimum of four cases and encompass one conventional and one unusual search location when discussing the four specific areas of the essay. Your completed assignment should be a minimum of two pages, not counting the reference page, and should be typed in 12-point, Times New Roman font. All outside sources should be properly cited in APA format.
