The UCC was designed and adopted to make business people more comfortable in dealing with other sales people in other parts of the country. As a uniform law, the UCC gives merchants and nonmerchants protection in that that the laws from one state regarding sales is substantially the same in all other states. Under the rules, merchants are held to a higher standard than nonmerchants in almost every situation. Do you feel that we are a sophisticated enough society with all of our modern advancements and technology that we should do away with the nonmerchant exception to the rules and make everyone regardless of whether they are a merchant have to recognize all of the additional duties (fairness and industry standards)? Why or why not?
